General terms and conditions of sale

These terms govern the sale of the digital book offered on this site. They are accepted by the customer at the time of the order.

Article 1 - Purpose

These general terms and conditions of sale (the "Terms") set out the rights and obligations of the parties in the distance sale of the digital book Escaping Pornography (the "Product"), offered on The Quiet Liberation.

Any order placed on this site implies full acceptance of these Terms, in the version in force on the day of the order.

Article 2 - Seller

The seller's full identity, address and registration number are set out in the legal notice.

Article 3 - Description of the Product

The Product is a book in digital format, delivered as a single PDF file. It is not a physical item, a subscription, or a one-to-one coaching service.

  • Format: PDF file, readable on a computer, tablet or phone
  • Language: that of the version of the site from which the purchase is made
  • No user account is created, no subscription is taken out

The Product is informational and educational in nature. It does not constitute medical, psychological or therapeutic advice and is not a substitute for consulting a healthcare professional.

Article 4 - Price

The price of the Product is €17, all taxes included. It is a one-off payment: no later charges, no automatic renewal.

The price shown on the payment page at the time of the order prevails. The seller reserves the right to change prices at any time, it being understood that the applicable price is the one in force on the day of the order.

Article 5 - Ordering and payment

Orders are placed directly from the site, without creating an account. Payment is processed by Stripe, a payment service provider, on a secure page hosted by Stripe.

The seller never has access to the customer's card details and keeps no copy of them. The order becomes firm and final once payment is confirmed by Stripe.

Article 6 - Delivery

The Product is sent by email, to the address given by the customer at checkout, immediately after payment is confirmed. In practice delivery takes a few minutes.

It is the customer's responsibility to enter a valid, accessible email address. If nothing arrives, the customer should first check their spam folder, then contact the seller at the address given in the legal notice. The file is then resent free of charge.

Article 7 - Right of withdrawal

Under article L221-28, 13°, of the French Consumer Code, the right of withdrawal cannot be exercised for contracts supplying digital content not provided on a tangible medium where performance has begun after the consumer's prior express consent and express waiver of their right of withdrawal.

By ticking the consent box shown before payment, the customer:

  • expressly requests that performance of the contract begin immediately, that is, before the fourteen (14) day withdrawal period expires;
  • acknowledges that they expressly waive their right of withdrawal as soon as the file is made available.

This box is not pre-ticked: payment cannot be started until the customer has ticked it themselves.

Article 8 - Licence of use, resale and redistribution

The Product is sold under a personal, non-exclusive and non-transferable licence: one copy, one reader. The customer may download, keep and print the file for strictly private use.

The following are prohibited, unless the seller gives prior written consent:

  • reselling, renting or lending the file, whether for free or for a fee;
  • redistributing the file, putting it online or sharing it on any medium, network, platform, messaging service or storage service accessible to third parties;
  • reproducing, translating or adapting all or part of the work;
  • removing or altering the ownership notices and any markings contained in the file.

The low price of the Product depends on this licence being respected. Any breach constitutes infringement within the meaning of articles L335-2 et seq. of the French Intellectual Property Code and exposes the infringer to the penalties provided by law.

Article 9 - Refunds

Given the waiver of the right of withdrawal set out in article 7, the sale is firm and final as soon as the file is delivered. No refund is owed solely on the grounds that the content did not match the customer's expectations.

A full refund is however granted in the following cases:

  • a demonstrated technical problem making the file unreadable or incomplete, which resending has not resolved;
  • failure to deliver the file, where that failure is attributable to the seller;
  • duplicate payment or a manifestly erroneous payment.

Requests should be sent by email within thirty (30) days of purchase, stating the address used at checkout. Refunds are issued through Stripe, to the original payment method.

Article 10 - Liability

The seller undertakes to use reasonable means to keep the site available and to deliver the Product correctly. The seller cannot be held liable for unavailability attributable to the network, the host, the payment provider, the customer's email provider, or to force majeure.

The customer remains solely responsible for the use they make of the content of the book.

Article 11 - Personal data

Data collected as part of an order is processed in accordance with the privacy policy, which forms an integral part of these Terms.

Article 12 - Governing law and disputes

These Terms are governed by French law.

In the event of a difficulty, the customer is invited to contact the seller in order to seek an amicable solution. Under article L612-1 of the French Consumer Code, consumers may refer the matter free of charge to a consumer ombudsman.

Consumers resident in the European Union may also use the online dispute resolution platform provided by the European Commission.
